Terms of Service

These Terms of Service ("Terms") govern access to and use of ComplianceDesk (the "Service"), provided by Elestack Digital Solutions ("Elestack", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organisation you represent ("Customer").

1. The Service

ComplianceDesk is a multi-tenant compliance management platform that lets organisations track controls, assign work, store evidence and report on compliance status across one or more regulatory or industry frameworks (e.g. POPIA, GDPR, B-BBEE, ISO 27001). The Service is a tool to help manage compliance activities; it does not constitute legal, audit or compliance advice, and using it does not guarantee compliance with any law, regulation or standard.

2. Accounts and organisations

You must provide accurate information when creating an account and keep your credentials secure. Each organisation workspace is isolated from others on the platform. Organisation owners and admins are responsible for the membership, roles and content within their organisation, including content uploaded by their members.

3. Customer data and evidence

Customer retains all rights to the data, documents and evidence it uploads to the Service ("Customer Data"). Elestack will only access Customer Data to operate, secure and support the Service, or as required by law. Customer is responsible for ensuring it has the right to upload any document or piece of evidence to the Service.

4. Subscriptions and billing

Paid plans are billed on the tier and cadence selected at checkout. Fees are non-refundable except as required by law or as expressly stated at checkout. Downgrading or cancelling a subscription may restrict access to features or data associated with a higher tier, subject to the limits described on the billing page at the time.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access another organisation's data without authorisation, interfering with the Service's operation, or uploading unlawful content.

6. Termination

Either party may stop using or providing the Service at any time, subject to any applicable notice period in a separate order form or agreement. On termination, Customer Data will be retained for a reasonable period to allow export, then deleted in line with our data retention practices.

7. Disclaimers and limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, Elestack disclaims all warranties and will not be liable for indirect, incidental or consequential damages arising from use of the Service.

8. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to account owners. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
